Rumphi First Grade Magistrate’s Court on November 19 2019 convicted and sentenced a 45-year-old man, Wakisa Lweya to 14 years imprisonment with hard labour for defiling an 11-year-old girl which contravenes Section 138 (1) of the Penal Code.
The Court through State Prosecutor, Sub Inspector Rose Mwandelire, heard that the accused had carnally known the victim thrice between March and April 2019 at Mphompha area in the district.
The court further heard that the accused defiled the victim after he called her to his house as a neighbour to his father.
Mwandelire further told the court that, Lweya used to give the victim kamba puffs, juice and K150.00 for her not to disclose the ordeal.
On April 26 2019, the accused met the father of the victim who, in the midst of chatting, appreciated beauty of the victim, and that he would marry her if she was a grown up woman. The sentiments angered the father who reported the matter to his wife.
After interrogating her daughter, the victim revealed to the mother that Lweya defiled her for three times.
Later, the matter was reported to police who arrested the accused.
Appearing in court, the convict pleaded not guilty to the count which prompted the state to parade six witnesses who proved the case beyond reasonable doubts.
Later, the court convicted him.
In her submission, the prosecutor said the convict should have played a greater role in protecting the girl as a neighbour, but instead he chose the vice. She then prayed for a stiffer punishment to teach the convict a lesson and deter the would be offenders.
Passing judgment, First Grade Magistrate Cuthbert Phiri concurred with the state and slapped Lweya with 14 years jail term.
Lweya hails from Chikombwe Village, Traditional Authority Mwaulambia in Chitipa.
